What are my Damages under Arizona Law after an Accident?

Under the laws of Arizona, one who causes a car accident is responsible for all of the damages related to the accident suffered by those involved. Typically, damages stemming from a car accident may include property damage and bodily injury (damage to the vehicle occupants). A bodily injury claim is generally comprised of two categories:

  1. Compensatory Damages (past and future medical expenses, wage loss, and additional expenses related to any permanent injury)

            -and-

  1. General Damages (pain, suffering, loss of enjoyment of life, inconvenience, physical impairment, and other similar losses)

The dollar value of these categories of damages can vary, but often is far higher than unrepresented persons realize and the insurance company would have you believe. Arizona law requires every automobile owner to purchase a minimum of $15,000 of car insurance to pay for these categories of damages.  Unfortunately, your claims can exceed the amount available, in which case Sturgell Law Firm will help you recover additional damages through an underinsured motorist claim.  There are two types of mandatory car insurance in Arizona:

  1. PROPERTY DAMAGE LIABILITY COVERAGE– this coverage pays for the damage to the automobile involved in the accident and is paid out on behalf of the at-fault driver.  The minimum limit required for this type of coverage is $10,000.
  2. BODILY INJURY LIABILITY COVERAGE– this coverage pays on behalf of the at-fault driver for bodily injuries sustained in a motor vehicle collision. The minimum limit required under this type of policy is $15,000.

In Arizona, The Sturgell Law Firm PLLC fights to obtain the maximum recovery available, taking into account all potential insurance policies that can be reached.  Let us begin working on your behalf today and take the first step toward a successful resolution of your case.

How do I Make a Claim for Damages Sustained in an Arizona Accident?

To establish a claim for your personal injuries related to a motor vehicle accident in the State of Arizona, you must meet three requirements: 1) fault for the car accident must be proved, and it must be clear that the at-fault driver is responsible for causing the accident; 2) you must have incurred damages; and 3) you must prove that the damages being claimed were caused by the automobile accident.

The Sturgell Law Firm can help you prove what is necessary to obtain the maximum recovery possible under the laws of the State of Arizona.

What Can I Recover in Arizona after being Involved in an Accident?

Bodily Injury Damages: Bodily injury damages can be divided into different categories: 1) economic damages, which include past and future medical expenses, past and future wage loss, impairment of earning capacity, and other out-of-pocket expenses; and 2) non-economic damages, which include inconvenience, loss of quality of life, emotional distress, pain and suffering; and physical impairment and disfigurement.

Who Will Pay for my Medical Expenses After an Arizona Automobile Accident?

The person who causes the automobile accident (or their insurance company) is financially responsible for all reasonable and medically necessary accident-related medical expenses caused by the accident. Rarely are the medical expenses paid by the at-fault driver (or their insurance company) at the time the medical expenses are incurred.  Thus, in almost all cases, one must submit a claim for reimbursement for their medical expenses. This reimbursement is paid as part of a single sum settlement fund that is negotiated only after all accident-related medical care is complete. Thus, many clients face financial challenges in covering their medical expenses prior to settlement of their claim. At The Sturgell Law Firm, we can help. We explore all avenues to insure that our clients suffer the minimum amount of financial stress necessary as a result of their accident.  This will include researching all possible insurance policies, utilizing health insurance to the advantage of the client, and possibly negotiating with providers in an attempt to persuade them to wait for payment until a successful settlement is obtained.

Medical Payments Coverage

A “medical payment” policy is an optional form of coverage that some clients may have previously purchased from their insurance carrier.  This policy requires our client’s own auto insurance company to pay some portion of the client’s medical expenses.  The Sturgell Law Firm assists clients in exhausting this coverage so as to pay off as much of their medical bills as possible prior to settlement.  In addition to minimizing the financial stress a car accident can take on our clients, this practice ensures that our clients receive the maximum net recovery in their pockets at the conclusion of the case. Additionally, The Sturgell Law Firm will attempt to obtain the limits of your medical payments policy free of charge.  At The Sturgell Law Firm, we believe that this is a free service that attorneys should provide in conjunction with their attempts to recover the maximum amounts possible against the at-fault party.

Why Should I Hire The Sturgell Law Firm as my Accident Lawyer?

Many clients inquire as to whether their losses are severe enough to warrant the hiring of an attorney.  Some clients feel as though they would rather simply attempt to handle their case on their own.  Still other potential clients feel simply overwhelmed by the mountain of issues facing them as a result of being injured in an Arizona auto accident.  Simply put, potential clients cannot lose by contacting The Sturgell Law Firm because we always offer a 100% free consultation to Arizona accident victims. We are more than happy to answer any questions you may have regarding your potential claims and the challenges you are now facing.  Unfortunately, insurance companies in Arizona are purely economic creatures because they are for-profit companies.  Often, Arizona accident victims will be contacted repeatedly within days of an accident by the at-fault insurance company.  Unfortunately, many of our clients mistake this behavior for an act of generosity on the part of the carrier, when in fact, the insurance company’s motivation is often to obtain a quick, and for them, a beneficial settlement, minimizing exposure and maximizing profits.  For these reasons, we urge all Arizona car accident victims to call Sturgell Johnson immediately to fully understand their claims and their rights, and so they do not enter into an unfavorable situation by going it alone against a powerful insurance company.

How Much Will I Pay in Legal Fees if I Hire The Sturgell Law Firm?

Your initial consultation with The Sturgell Law Firm is always free.

Further, if we agree to accept your case, we work on a contingency fee.  A contingency fee means that you will never be charged by the hour for our services.  We simply agree to accept a percentage of the recovery we successfully obtain.  If we do not obtain a recovery in your case, you owe us no legal fees.  There exist several advantages for our clients to this fee structure.  First, you will not be forced to pay for our services out of pocket or prior to settlement.  Secondly, you can rest assured that we are your partner in this process. At The Sturgell Law Firm, we do not receive a dime until you recover.  Thus, we have the ultimate incentive to provide you with the highest quality and most aggressive representation

Uninsured and Underinsured Motorist Claims in the State of Arizona

Unfortunately, although Arizona law requires every automobile owner to maintain insurance on their vehicle, many drivers who cause accidents disregard this law, failing to maintain the required insurance.  These drivers are called “uninsured motorists.” In other cases, the driver who causes an accident may be insured but may not have sufficient insurance coverage to cover all of the medical expenses and lost wages incurred due to the accident.  These drivers are “underinsured.”

Often, our clients will ask “who will pay their damages if the at-fault driver does not have sufficient insurance coverage”?

In these situations, The Sturgell Law Firm explores all avenues of “first party” uninsured and underinsured coverage when available.  The Sturgell Law Firm has the experience and attention to detail required to provide our clients with the highest quality representation in these types of complicated situations, ensuring that you, the client, obtain the most favorable result possible.  Call 602.685.1061 today to put the Phoenix accident legal team of The Sturgell Law Firm to work for you.
